1. Agreement to Terms

By accessing or using TheMindTank ("we," "our," or "us") website at themindtank.co and related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our Services.

These Terms apply to all users, including visitors, students, instructors, and affiliates.

2. Eligibility

You must be at least 13 years old to use our Services. If you are under 18, you must have permission from a parent or legal guardian. By using our Services, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

To access certain features, you must create an account. When you create an account, you agree to:

When you enroll in a paid course, you agree to pay all applicable fees. All prices are in USD unless otherwise stated. Payment is processed securely through our third-party payment processor, Lemon Squeeze.

4.2 Course Access

Upon successful enrollment, you will receive lifetime access to the course content, unless otherwise specified. This includes all future updates to the course. However, we reserve the right to discontinue courses or modify content at our discretion.

4.3 Refund Policy

We offer a 30-day money-back guarantee for most courses. To request a refund:

• Contact us within 30 days of purchase
• Provide a valid reason for the refund request
• Have completed less than 30% of the course content

Refunds are processed within 5-10 business days. Special promotions, bundles, and mentorship programs may have different refund policies, which will be clearly stated at the time of purchase.

5. User Conduct

You agree not to:

• Share your account credentials with others
• Download, copy, or redistribute course content without permission
• Use our Services for any illegal or unauthorized purpose
• Harass, threaten, or abuse other users or instructors
• Post spam, malware, or malicious content
• Attempt to hack, reverse engineer, or compromise our Services
• Scrape, data mine, or use automated tools to access our content
• Impersonate others or provide false information

Violation of these conduct rules may result in immediate account termination without refund.

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Access and view course content for personal, non-commercial use
• Download materials explicitly provided for download (templates, resources)
• Use course content for your own learning and skill development

6.3 Restrictions

You may not:

• Reproduce, distribute, or publicly display our Content
• Create derivative works or modify our Content
• Sell, rent, lease, or sublicense our Content
• Remove copyright or proprietary notices from our Content

6.4 User Content

When you submit content (reviews, comments, feedback), you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, and display that content for the purpose of operating and promoting our Services.

7. Mentorship and Affiliate Programs

7.1 Mentorship Program

If you enroll in a mentorship program, additional terms may apply. Mentorship sessions are scheduled in advance and must be attended at the agreed time. Missed sessions may not be refunded unless rescheduled with at least 24 hours notice.

7.2 Affiliate Program

Affiliates must follow our Affiliate Program Terms, which include guidelines for ethical promotion, prohibited marketing practices, and commission structures. Violation of affiliate terms may result in commission forfeiture and program termination.

8. Disclaimers

No Guarantees: TheMindTank provides educational content and resources. We do not guarantee specific income results, job placements, or business success. Your results depend on your effort, skills, market conditions, and other factors beyond our control.

Services "As Is": Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Accuracy: While we strive to provide accurate and up-to-date information, we do not warrant that our Content is complete, reliable, or error-free. Course content may become outdated as industries and technologies evolve.

9. Limitation of Liability

To the maximum extent permitted by law, TheMindTank and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or other intangible losses resulting from:

• Your use or inability to use our Services
• Any unauthorized access to or alteration of your data
• Any errors or omissions in our Content
• Any business decisions made based on our Content

Our total liability to you for all claims arising from your use of our Services shall not exceed the amount you paid us in the 12 months prior to the event giving rise to the liability, or $100 USD, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless TheMindTank and its officers, directors, employees, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising out of or in any way connected with your use of our Services, violation of these Terms, or infringement of any third-party rights.

11. Termination

We reserve the right to suspend or terminate your account and access to our Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use our Services will immediately cease.

You may also terminate your account at any time by contacting us at support@themindtank.co. Termination does not entitle you to a refund.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our Services shall be resolved through binding arbitration in accordance with the rules of the Malaysian Arbitration Centre, except that either party may seek injunctive relief in court.

You agree to waive any right to a jury trial or to participate in a class action lawsuit.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of our Services after changes are posted constitutes your acceptance of the revised Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and TheMindTank regarding your use of our Services and supersede all prior agreements and understandings.
